Affirmative Action Program

Who Needs an Affirmative Action Program?

Federal Regulations require that a contractor / subcontractor with 50 or more employees annually develop and maintain an Affirmative Action Program for each of its facilities if:

  • The contractor / subcontractor has a total of $50,000 or more in federal contracts / subcontracts; OR
  • Has Government bills of lading which in any 12-month period, total or can reasonably be expected to total $50,000 or more; OR
  • Serves as a depository of Government funds in any amount; OR
  • Is a financial institution which is an issuing and paying agent for U.S. savings bonds and savings notes in any amount.
In addition, an Affirmative Action Program is required for Veterans and the Disabled.

A contractor / subcontractor has 120 days from commencement of a government contract to develop a written Affirmative Action Program for each of its facilities that meet the above criteria.
